BOARDING AGREEMENT

Welcome to Windwalker Farm. We started our farm in June of 1996. We had three horses and were looking for a place to board. We could not afford to board in Prospect so we purchased this farm. Edward had no knowledge of horses when we bought our horses and this farm. His family had cattle and grew tobacco.

Phyllis had a horse as a child and rode daily, the cowgirl way with no formal training. Phyllis has always been athletic and well balanced and could stay on a horse but never had lessons. Her family had cattle and tobacco. This was the accumulative knowledge they had when they began their breeding and training operation.

KNOWLEDGE:

Each boarder is responsible for their knowledge (or lack there of) of horses and horse care. We do not hold ourselves out as “experts”. If you have questions we may answer them to the best of our ability but you are responsible for doing your own reading and research. We offer lessons at a nominal fee and will answer questions asked in that context to the best of our abilities.

WE PROVIDE:

  • Pasture/hay/water in field
  • use of arena
  • use of outside wash area
  • use of round pen (check availability with owner)
  • use of tack room to store saddles and other equipment
  • we do not insure for loses or damages and cannot be responsible to your equipment therefore you assume risk for lost, damage or stolen items.

PASTURE BOARD DOES NOT INCLUDE:

  • use of stalls
  • use of indoor wash area
  • grains/square-baled hay
  • use of grooming tools or products (brushes, show sheen, shampoo, etc.)
  • use of supplements
  • use of medicines (wormer, vaccines, etc.)
  • use of tack/equipment ( saddles, bridles, halters, helmets, martingales, etc.)
  • any labor associated with special feedings of grains, blanketing horses, etc.
  • medical treatment or advice
  • veterinarian care
  • training of horse or rider
  • supervision of horse or rider
  • transportation of horse or rider (transportation cost of horse is $1.00 per mile.

BOARDER FURNISHES:

  • grains, supplements, square baled hay
  • grooming supplies/tools (shampoo, fly spray, brushes, etc.
  • medicines, vaccines, worming products, treatment products
  • equipment needs for riding/training of horse and rider
  • feeders/buckets for use only by boarder
  • tack box to contain supplies/equipment clearly marked with boarders/horses name
  • own health insurance
  • own liability insurance ( should you allow someone else to ride your horse and they sustain injury or for your own injury)
  • comprehensive to cover loss of saddles, equipment, etc.

USE OF WATER HOSES:

We purchase approximately ten water hoses a year. Horses standing on the hose will puncture it. Driving your car over them on gravel, will puncture it. Pulling on a hose when it is kinked, will puncture it. If it is winter and the hose is frozen, driving on it will shatter it. Please help us take care of the hoses and nozzles. It takes time to run all the errands.

Water buckets are like hoses when frozen and will break if hit hard to break ice in them. We place them upside down in the sun and the sun heats the black bucket and melt them so the ice slide out without cracking the bucket.

Water tanks will have heaters in them in the wintertime but may still have thick ice that needs breaking and removed using a pitchfork.

BARN DOORS:

It is “very important” that the back barn doors be kept closed on windy days. For some reason the wind does not just travel through the driveway, it will blow the roof off of the barn at a cost of ten thousand dollars.

PARKING:

  • Please park in the area on the left before entering the barn lot (unless unloading)
  • Be careful when driving/approaching arena to avoid spooking a horse and injuring a rider.
  • We are not responsible for damages to cars or theft.

GATES AND FENCES:

  • If you go through a gate that was closed, please return it to that position.
  • Pick up on all gates when opening them. Leaning against a gate while opening it will pull out the hinge and require four hours of repair to replace the post at a cost of $300.00.
  • Please pick up on gates when opening.
  • Do not climb gates or fences
  • Wire fences are “hot” and “will” result in shock. Please be responsible for your children and guest.

PETS:

Your dogs are not permitted due to the possibility of injury to the dog or spooking a horse creating an injury to the rider. We love dogs and know that your dog would enjoy running in the country but we have had our herds chase dogs and paw them as they would a coyote or a mountain lion in the wild.

STALLIONS (DANGER)

  • Stallions are kept in the barn. We ask that you not pet the stallions. They are oral and play with their mouth. They “will” bite your fingers off.
  • Please keep your guest away from the stallions and out of the barn for their protection and ours.
  • Do not lead a horse past a stallion stall if the door is open. The stallion may try to get to the mare or gelding. They are aggressive. Sometimes the door is open if someone is feeding cleaning, taking a wheel barrel in out throwing hay, or graining.

INJURY TO YOUR HORSE:

Horses by nature are herd animals. They do not like being alone. They feel safer in a herd; however, they do have pecking orders and may fight to establish their positions, resulting in injury. You assume responsibity for any injury to your horse. You are “not” responsible for injuries your horse may inflict on other horses because no one can control that.

INJURY TO YOU OR YOUR GUESTS:

Horseback riding is a sport and if you participate in sports you are likely to get injured. I do not know anyone that has ridden very long and not thrown or had his or her foot stepped on by a horse. You are responsible for researching the statistics to determine your level of risk. People have been killed when their horse reared, threw them or kicked them. We all want to share the joy of horseback riding with our friends but if they are hurt it could result in them against you and us. This is especially true when parents allow you to bring their children. They may say they were not fully informed of the risk when they gave permission, “I didn't know they were going to injure my child”

HOLD HARMLESS - RELEASE OF LIABILITY:

This property known as Windwalker Farm, located on Hwy. 53 is private property. As a visitor to the property, I acknowledge that I may encounter certain hazards. I understand that horses, some of which are stallions, which are aggressive and dangerous, occupy the land. I understand that horses, though somewhat domesticated, are wild animals. A horse, regardless of training and usual past behavior, may act unpredictably at times base upon instinct or fright, which may cause you to be thrown from your horse or injured by the horse. Horses may do such things as bite, kick, buck, lie down or stumble. Saddles may slip and other tack problems may develop as a result of normal use and wear.

Riding a horse requires the participant to balance in the saddle. Participants may lose their balance that can result in falling from the horse.

I understand that most of the property is unimproved; that the ground may not be level in places and that there are several ponds on the property, which may pose a danger to unsupervised children.

In consideration for permission to visit the property, I agree to exercise due care to avoid personal injury to myself and to the minor children under my care who are visiting with me. In the event that I sustain, or any minor child in my care, sustains an injury, during any visit to the property, I agree to hold the owners of the property harmless against any cause of action for damages sustained as a result of that accident, including, without limitation, actions for personal injury, property damage, claims for emotional distress, either negligent or intentional, and any and all other claims of any kind or nature arising out of my use of the premises commonly known as Windwalker Farm.
